This End User License Agreement (the "Agreement") is between you and Furkan Semiz ("we", "us"), the developer of Daily Museum of Art (the "App"). By downloading or using the App you agree to it. If you do not agree, do not use the App.
This Agreement covers your licence to use the App. Your use of the service the App connects to is additionally governed by our Terms of Service and Privacy Policy.
You acknowledge that this Agreement is concluded between you and us only, and not with Apple Inc. We, not Apple, are solely responsible for the App and its content. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.
We grant you a non-transferable licence to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions, except that the App may be accessed by other accounts associated with you via Family Sharing or volume purchasing.
You may not rent, lease, lend, sell, redistribute or sublicense the App, or copy, decompile, reverse-engineer, disassemble, or attempt to derive its source code, except as permitted by applicable law.
We are solely responsible for providing any maintenance and support services for the App, as specified in this Agreement or as required by applicable law. You can reach us at info@dailymuseumart.com. Apple has no obligation to furnish any maintenance or support services for the App.
The App is provided "as is". To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including any implied warranties of merchantability and fitness for a particular purpose.
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to any warranty are our sole responsibility.
We, not Apple, are responsible for addressing any claims by you or any third party relating to the App or your possession and use of it, including: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
The artworks shown in the App are in the public domain, and we verify the licence of each image file before publishing it. Where the App displays encyclopedic text from third parties, it is credited and shown under its own licence. Our own material — the daily stories, translations, name, design and code — remains ours, and the licence above does not transfer it to you.
You may read, save and share individual artworks and their descriptions for personal, non-commercial purposes. Please do not republish our written content in bulk or use it to train a model without asking first.
In the event of any third-party claim that the App or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim. If you own rights in something published in the App, write to info@dailymuseumart.com and we will review and, where the claim is substantiated, remove or replace the content promptly.
You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
You must comply with applicable third-party terms of agreement when using the App — for example, your wireless data service agreement.
You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this Agreement, and that upon your acceptance of it Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary.
This licence is effective until terminated. It terminates automatically if you fail to comply with any of its terms. You may terminate it at any time by deleting the App. Sections 5 through 10 survive termination.
We may update this Agreement. If we make material changes we will update the date above and, for significant changes, notify you in the App.
This Agreement is governed by the laws of the Republic of Türkiye, without regard to its conflict-of-law rules, except where mandatory consumer protection law in your country of residence provides otherwise.
